Official Rules: Eligibility: Promotion is open to all individuals who are 18 or older and a legal resident of the fifty (50) United States or the District of Columbia. Employees of Baker’s Crust, Inc., its affiliates, subsidiaries, and the immediate family members, and persons living in the same household of such persons are not eligible. Additional restrictions may apply. Entry: An eligible individual receives one automatic entry for every $300 of catering orders paid for during the promotion period. The entry process will be supervised by Baker’s Crust Catering Managers and General Managers, and their decision on matters regarding entry will be final. The initial promotion period runs from the start of the business day July 1, 2010 though the end of business day July 31, 2010. Additional promotion periods may be announced. Prize: One (1) winner will win one (1) grand prize. The grand prize is one (1) Apple iPad, valued at approximately $500. No cash or other prize substitution is permitted. Odds of winning are dependent upon the number of eligible entries submitted by the end of the promotion period. Random Drawing: The grand prize will be awarded in a random drawing within one week of the conclusion of the promotion period. The President of Baker’s Crust, Inc., will conduct the drawing, and his decision on matters regarding the drawing will be final. Winner Notification/Verification: The potential grand prize winner will be notified by phone and/or mail and will be required to return an affidavit of eligibility and liability release within ten (10) days of notification attempt. Noncompliance within this time period may result in disqualification and the prize will be forfeited and an alternate winner may be selected. Donation: Baker’s Crust, Inc., will make a donation to a charitable organization of its choosing based on the number of eligible entries submitted by the end of the promotion period. The amount of the donation will be at least $200. The charitable organization will be tax exempt under section 501(c)(3) of the Internal Revenue Code. Baker’s Crust may include the name of a specific charitable organization in its promotional materials. General Rules: By entering, each participant agrees (a) to be bound by these Official Rules and the decisions of Baker’s Crust, Inc., which shall be final, and (b) that Baker’s Crust, Inc., agents and representatives of Baker’s Crust, Inc., its parent companies, affiliates, subsidiaries, officers, directors, employees, legal advisors and advertising, promotion, fulfillment agencies are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible, postage-due entries, mail, or e-mail; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of Baker’s Crust, Inc., that may cause the promotion to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the promotion including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy; or (vi) any printing or typographical errors in any materials associated with the promotion. Baker’s Crust, Inc., reserves the right, in its sole discretion, to modify, suspend, or cancel the promotion at any time if the promotion is not capable of running as planned, including if a computer virus, bug, or other technical problem corrupts the administration, security, or proper running of the promotion. Baker’s Crust, Inc., reserves the right at its sole discretion to disqualify any individual or entity it finds to be attempting to defraud or in any way tamper with the promotion. As a condition of participating in this promotion, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Virginia having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participants' actual out-of-pocket expenses (i.e. costs associated with entering this promotion), and participant further waives all rights to have damages multiplied or increased.
